Personal information you provide to FlyCast is governed by FlyCast' privacy policy, which can be found elsewhere on this site. Your use of FlyCast' software indicates your acceptance of the terms of our privacy policy, so please review it carefully.
You are responsible for maintaining the confidentiality of your password and account information. You are responsible for all activities that occur in your account and you agree to notify FlyCast immediately of any unauthorized account use. FlyCast is in no way responsible for any loss that you may incur as a result of any unauthorized use of your user account and password. FlyCast may send email to the address you provide from time to time with new features and services. FlyCast will never divulge your email address to any other company.
AUTOMATIC COMMUNICATIONS FEATURES
a) FlyCast consists of interactive applications that perform a variety of communications over the Internet as part of their normal operation. A number of communications features are automatic and are enabled by default. Once you log into FlyCast, information including your User ID will be sent in communications with FlyCast's servers. FlyCast may match the User ID to personally identifiable information in order to provide you with products, services, and software to which you are entitled.
b) Cookies: FlyCast allows the use of cookies. If you have disabled cookies, you may be asked to login each time you access features and services, and some FlyCast services may not function properly.
c) AutoUpdate: FlyCast automatically communicates with FlyCast' servers on the Internet using AutoUpdate to check for updates to FlyCast' and its partner's software, such as bug fixes, patches, enhanced functions, missing plug-ins and new versions. AutoUpdate also has the capability to run independently of FlyCast to perform background update checks. FlyCast may download updates during the background checks, when it automatically communicates with FlyCast' servers, when you manually check for updates, or when FlyCast detects a file it does not support. AutoUpdate sends information about installed FlyCast products and components to the servers to determine upgrade availability.
d) Data and Feedback Transmission to FlyCast servers: FlyCast will send data to FlyCast' servers regarding the consumption of content by an end user. This data may be stored for indefinite periods of time.
To the extent required by law, the Software embodies a serial copying management system. You may not circumvent or attempt to circumvent this system.
FlyCast is provided as is, without any warranty. To the maximum extent permitted by law, FlyCast explicitly disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The entire risk arising out of your use of FlyCast remains with you. Uninstalling the FlyCast software is your sole remedy with respect to any dispute with FlyCast. To the maximum extent permitted by law, FlyCast will not be liable for any direct, consequential, incidental, indirect, special, punitive, or other damages whatsoever arising out of our relationship.
